Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by AKIYA x MUSUBI (operated by ARM System Co., Ltd.). By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our services.

1. Services Provided

AKIYA x MUSUBI offers services related to the identification, matching, and facilitation of vacant property (akiya) opportunities across Japan. Our services are designed to assist individuals, including foreign nationals, in navigating the process of finding, evaluating, and connecting with suitable akiya properties. Services may include consultation, property matching, coordination with local agents and specialists, and administrative support.


2. Eligibility

To use our services, you must be at least 20 years of age and legally capable of entering into binding contracts under the laws of your country of residence and under Japanese law. By using our services, you confirm that you meet these requirements.


3. Service Process

3.1 Initial Consultation

We offer consultations to understand your needs, preferences, and circumstances regarding akiya properties. This may include guidance on location, property type, budget, and legal requirements.

3.2 Property Matching

Based on your requirements, AKIYA x MUSUBI will work to identify and present suitable akiya options, coordinating with relevant parties to provide you with the necessary information to make an informed decision.

3.3 Acquisition Support

We will support you through the acquisition process, including coordination with licensed real estate agents, legal professionals, and local authorities as required.


4. Fees and Payment

Service fees will be outlined in a separate agreement provided at the start of the engagement. All fees must be paid in accordance with the agreed schedule. Failure to make payment on time may result in the suspension or termination of services.


5. Cancellation and Refunds

5.1 General Policy

All payments made to AKIYA x MUSUBI are in principle non-refundable in the event of cancellation by the client. This includes consultation fees, service fees, and any other charges specified in the agreement. Once payment has been made, it is considered final regardless of the outcome of the property search or acquisition process.

5.2 EU and UK Consumer Rights — Statutory Cooling-Off Period

If you are a consumer located in the European Economic Area (EEA) or the United Kingdom, you have the right under applicable consumer protection law (including the EU Consumer Rights Directive and the UK Consumer Rights Act 2015) to withdraw from a distance contract within 14 calendar days of entering into it, without giving any reason.

To exercise your right of withdrawal, you must notify us within this 14-day period by contacting us at contact@akiyaxmusubi.com with a clear statement of your decision to withdraw. We will acknowledge receipt promptly.

Where applicable, any refund due will be processed within 14 days of receiving your withdrawal notice, using the same payment method as the original transaction unless otherwise agreed.

5.3 Waiver of Cooling-Off Period

If you are an EEA or UK consumer and you explicitly request that we begin providing services before the 14-day cooling-off period expires, you acknowledge that your right of withdrawal will be lost once the services have been fully performed. Where services are partially performed, a proportionate refund may apply for the unperformed portion. Any such waiver must be made in writing and confirmed by AKIYA x MUSUBI prior to commencement of services.

6. Client Responsibilities

You are responsible for ensuring that all actions taken under these Terms comply with applicable Japanese laws and regulations. AKIYA x MUSUBI will provide guidance throughout the process, but we strongly recommend seeking independent legal advice where necessary. You are also responsible for the accuracy of any information you provide to us.


7. Limitation of Liability

AKIYA x MUSUBI provides services on an “as-is” basis and makes no warranties regarding the accuracy or completeness of information provided. To the extent permitted by Japanese law, AKIYA x MUSUBI and its affiliates, employees, agents, and partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our services, including but not limited to loss of profits, property disputes, or delays in the acquisition process. Use of our services is at your own risk.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable mandatory law, including consumer protection rights applicable in your country of residence.


8. Intellectual Property

All content on our website and materials produced by AKIYA x MUSUBI, including text, images, and branding, is the intellectual property of AKIYA x MUSUBI or its licensors. Unauthorised reproduction or use of any content is prohibited.


9. Termination

Either party may terminate the service agreement by providing written notice. Upon termination, the client remains responsible for payment of any outstanding fees for services already rendered.


10. Privacy and Confidentiality

AKIYA x MUSUBI handles your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. Any confidential information shared during the provision of services will not be disclosed to unrelated third parties without your prior consent.


11. Governing Law and Dispute Resolution

11.1 General

These Terms are governed by the laws of Japan. In the event of any dispute arising from these Terms or the use of our services, the parties shall first attempt to resolve the matter through good-faith negotiation. If unresolved, disputes shall be submitted to arbitration in Tokyo, Japan, in accordance with applicable Japanese arbitration procedures.

11.2 EU and UK Consumer Rights — Mandatory Protections

If you are a consumer resident in the European Economic Area or the United Kingdom, nothing in Section 11.1 affects your right to bring proceedings before the courts of your country of residence, or to benefit from any mandatory consumer protection provisions applicable under the law of your country of residence that cannot be derogated from by contract.

In particular, EU consumers retain the right to access the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr for the resolution of disputes. Our email address for ODR purposes is contact@akiyaxmusubi.com.


12. Changes to These Terms

AKIYA x MUSUBI reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our services after any changes constitutes your acceptance of the revised Terms. For material changes, we will take reasonable steps to notify existing clients directly.
